Visa Appeal
Visa Appeal when Refused – ART (Administrative Review Tribunal)
What is ART?
The new body replacing the AAT from 14 October 2024, specializing in reviewing visa refusals or cancellations made by the Australian Department of Home Affairs.
ART (Administrative Review Tribunal) is the Administrative Review Tribunal in Australia. It is a quasi-judicial body responsible for reviewing administrative decisions made by federal government agencies or certain state authorities.
Main Functions
ART allows individuals or organizations to appeal if they believe a government agency’s administrative decision is incorrect, unfair, or unreasonable.
Unlike courts that only conduct a “procedural check,” ART has the authority to carry out a full “merits review,” meaning it steps into the shoes of the original decision-maker to issue a new decision.
Areas Commonly Reviewed by ART
Immigration and visa decisions
Social security
Taxation matters
Decisions of professional licensing and regulatory bodies
Other federal government administrative decisions
Who Can Appeal?
- Applicants who receive a visa refusal/cancellation letter specifying appeal rights.
- Timeframe to lodge an application: 9–28 days depending on the visa type.
Basic Process
1. Receive refusal letter and check appeal rights.
2. Prepare application and additional supporting evidence.
3. Lodge the appeal with ART.
4. Attend the hearing and await the outcome.
• Possible Outcomes:
- The refusal decision is upheld, or
- The decision is overturned, allowing the visa to be granted.
- If still refused → the case may be taken to the Federal Court, but only on legal error grounds.
• Important Notes:
- ART fully replaces AAT and IAA from 2024.
- Applications already under review at AAT are automatically transferred to ART.
- ART ensures decisions are more transparent, objective, and fair.
